2. Technology Provider Classification

ApexStrat operates exclusively as a software technology provider. The company develops, deploys, and maintains algorithmic trading software that customers run within their own infrastructure and broker accounts.

ApexStrat does NOT:

  • Hold, manage, or custody client funds or assets
  • Execute trades on behalf of clients
  • Provide investment advice or financial recommendations
  • Operate as a broker, dealer, or market maker
  • Pool client funds or operate any form of collective investment

ApexStrat DOES:

  • Provide software tools that run on customer-owned AWS infrastructure
  • Deploy algorithmic strategies to isolated customer satellite accounts
  • Give customers full transparency and control over their trading environment
  • Bill customers for software infrastructure (€500/product/month) and performance (20% of profit)

3. Regulatory Framework

As a UAE IFZA-incorporated technology company that does not conduct regulated financial activities, ApexStrat is not required to hold a financial services license from the Securities and Commodities Authority (SCA), the Dubai Financial Services Authority (DFSA), or any other financial regulator.

Customers using ApexStrat’s software to trade financial instruments through their own broker accounts are subject to the regulatory requirements and terms of their chosen broker. ApexStrat does not supervise, endorse, or take responsibility for any broker relationship.

4. GDPR & Data Protection

ApexStrat processes personal data of EU/EEA-based customers in accordance with the General Data Protection Regulation (GDPR). Our data infrastructure is hosted in the AWS eu-central-1 (Frankfurt) region for EU customer data.

5. Anti-Money Laundering (AML)

ApexStrat operates AML and Know Your Customer (KYC) procedures as part of its customer onboarding process. We may request identity verification documents from customers during the account setup phase. Customer data collected during KYC is processed in accordance with applicable data protection law and retained for the legally required period.

ApexStrat reserves the right to refuse or suspend service to any customer where AML/KYC requirements cannot be satisfied.

6. Sanctions Compliance

ApexStrat does not provide services to individuals or entities located in, or subject to the laws of, jurisdictions subject to comprehensive sanctions by the United Nations, the European Union, the United States (OFAC), or the United Arab Emirates. Customers must confirm they are not subject to such sanctions during account registration.

7. Marketing Compliance

All performance data, statistics, and strategy descriptions presented on the ApexStrat website are based on historical backtesting. They must not be interpreted as guarantees or projections of future performance.

Sales partners and affiliates are required to comply with the Partner Marketing Guidelines and may only use pre-approved materials and statements when representing ApexStrat. Unauthorised claims, performance guarantees, or misleading statements are strictly prohibited and may result in immediate termination of partner status.

8. Conflict of Interest

ApexStrat’s revenue model (€500/month fixed fee + 20% performance fee) is designed to align ApexStrat’s financial interests with customer success: the performance fee is only charged when customers profit. ApexStrat does not earn commissions from brokers or any third party based on customer trading volume.
